Terms and Conditions

Terms of Sales Agreement: Buyer Acknowledgement

  • Buyer’s      Responsibilities Prior to Install: Buyer acknowledges that prior to the      installation of the Structure. Buyer shall ensure that all underground      utilities are flagged off and the construction.
  • Lead      Time Commencement: Buyer acknowledges that all lead times associated with      Buyer’s Structure shall commence upon Buyer’s site being adequately      prepped for installation. Any lead time associated with Buyer’s order      shall commence once Buyer obtains a permit and the concrete slab, where      applicable, has been finished. Buyer further acknowledges that production,      delivery, and installation lead times are only estimates and are subject      to change.
  • Modifications      to Steel Structure: Buyer acknowledges that any modification to the      Structure, not preauthorized by the manufacturer, may void the Limited      Warranty issued under this Sales Agreement. Buyer further acknowledges      that the Structure is not pre-designed to have electrical, added flooring      or lofts, etc. installed directly into the metal panels or framing. Any      electrification of the building should be installed only by licensed      electricians and encased in proper conduit. Any significant modification by      the Buyer compromises the structural integrity of the unit may void the      limited warranty.
  • Structure      Anchoring: Buyer acknowledges that the Structure purchased should only be      anchored by a manufacturer certified anchoring system. Any failure to      anchor the steel structure with a certified anchoring system will result      in a voiding of the wind warranty provided by manufacturer to Buyer.
  • Insurance:      It is the Buyer’s sole responsibility to obtain insurance coverage on the      Structure. Northern Star Buildings LLC highly recommends that Buyer obtain      insurance coverage on the Structure. Manufacturers do not insure the      Structure once unloaded from delivery.

Terms & Conditions:

Northern Star Buildings LLC (“the Dealer”) is a trusted on-line dealer for multiple steel building manufacturers nationwide. You can think of the dealer as a customer advocate that is here to assist you in the design and purchasing process of a steel building or structure of your choosing. The dealer keeps current on pricing & lead times with multiple reputable manufacturers across the country. The dealer’s goal to the customer is simple: to assist you in every way possible to find or design the building that best suits your needs, desires, or activities, and to arrange for the timely installation of said structure on your level land or concrete pad at the best possible prevailing price for your location.
 

The following terms and conditions of our Dealer Service Agreement, which applies to all transactions with our customers, are as follows: Dealer’s Service Payment. When you order a building, you will be required to make a Dealer Service Payment (DSP) to the dealer, also known as a “Deposit”.
 

The DSP amount is based on the size of the structure, your install location, and the chosen Manufacturer of the steel building or structure. The DSP is non-refundable (subject to the further terms herein) as the dealer and his/her team have taken the time in advance to assist you with searching for, designing, perfecting, selecting and ordering the steel building that best meets your needs. In addition, when you choose your selected building based on the dealer’s guidance and the DSP amount is paid to the dealer, then we the dealer move forward with having your order processed by the manufacturer, which includes, but is not limited to the following: the creation of an engineered drawing for specifications of your chosen structure (if applicable), the delivery of the order and structure information to the Manufacturer for initial fabrication, communication with the Manufacturer for the manufacture of your chosen building regarding scheduling and other matters, and the dealer’s time to assist the customer with any other questions that he or she may have.
 

Depending on the size and/or price of a building, specifically larger width buildings and buildings priced over $15,000.00, most Manufacturers will require additional stage funding, generally 50% of the remaining balance at the beginning of actual factory component production and scheduling of your install, and 50% upon completion of installation after customer’s final inspection. In the event the Manufacturer requires additional stage funding, then any monies paid by the customer to the dealer in excess of the DSP, will be delivered to the Manufacturer. The customer agrees and understands that he or she has read and reviewed all Terms and Conditions set forth herein and that the customer’s payment of the DSP to the dealer demonstrates that he or she has read all terms and conditions herein and expressly agrees to the same. Upon the customer’s payment of the DSP, the dealer will immediately move forward with contracting the selected Manufacturer of the customer’s building.
 

Cancellation/Refunds: The dealer will only refund the customer’s DSP in the following instances:
 

1(a) – 72 Hour Free Look (3 day): As an act of customer goodwill, the dealer will give all customers a “72-hour Free Look” period after payment of the DSP. The 72-hour Free Look is a 3-day period of time that begins from the moment that the DSP is paid to the dealer until 72 hours later. The 72-hour Free Look Period includes business days and non-business days and is not tolled by any holidays. Any customer requesting to cancel his or her order must do so in writing within the 72-hour Free Look period and email said request to orders@northernstarbuildings.com. Any customer requesting his or her order canceled within the 72-hour Free Look Period will have his or her DSP refunded in full minus transfer fees, no questions asked.
 

1(b) - Permit Denial: In the event any government permitting department denies the customer’s request for a permit for the placement and/or construction of the customer’s building, then the customer must email the dealer a copy of the official written denial letter (on the permitting department’s letterhead). The customer must email the official denial letter to orders@northernstarbuildings.com. Upon the dealer’s receipt and review of the official denial letter, the dealer will refund the customer’s DSP in full. Any other requests by a customer for a refund of the entire DSP, or partial DSP for any reason must be made in writing to the dealer and sent to orders@northernstarbuildings.com. Any refunds issued by the dealer, except as set forth in Paragraph No. 1(a) and (b) herein shall be at the sole discretion of the dealer.
 

Pricing Correction(s): The customer agrees that the dealer is authorized to correct any pricing errors made by dealer concerning structure prices and/or local taxes. All buildings are priced solely for the building itself and its installation by independent contractors. The building price does not include site preparation, i.e. grading, foundation preparation, concrete, or any other necessary actions to ensure that the site location for the building is sufficient according to the manufacturer’s specifications. All actions and expenses for site preparation are borne by the customer. Depending on the customers location, the Dealer may assist customers in arranging ancillary services such as land prep, concrete, spray foam insulation or others services, but such services are additional and SOLD SEPARATELY from the building, and are not performed by the building manufacturer selected by the Dealer on your behalf.
 

Further Terms and Conditions. Governing Law and Choice of Law: The customer agrees that laws of the State of Texas shall govern any claims, demands, and/or lawsuit(s) filed against dealer, as well as the construction of this contract. Forum selection clause. The customer agrees that any and all claims regarding this agreement and/or any claims or disputes arising from the dealer’s services can only be filed with the Clerk of RUSK COUNTY in Rusk County Texas. The customer further agrees that any claims made against the dealer lodged in any other jurisdiction shall be removed to the Clerk of RUSK COUNTY in Rusk County Texas and the customer agrees to pay the dealer’s attorney’s fees associated with having any claim removed to the Clerk of RUSK COUNTY in Rusk County Texas. The customer, by signing this agreement, has purposefully availed himself or herself to the laws of the State of Texas and to the personal jurisdiction of the State of Texas. The customer shall pay the dealer’s reasonable attorney’s fees and costs for any claim that dealer is required to file to enforce this agreement and/or in the successful defense of any claim lodged by the customer.
 

Entire Agreement: This Agreement constitutes the entire Agreement between the dealer and the customer and supersedes all other prior oral or written Agreements and/or prior oral and/or written statements between the dealer and the customer. It is expressly understood that no amendment, deletion, addition, modification or waiver of any provision of this Agreement shall be binding or enforceable unless in writing, signed by both Parties and acknowledged by the Parties before a Notary Public.
 

The customer, by signing this agreement acknowledges that this agreement is a contract for the dealer’s services. The customer further agrees that the terms and conditions between he/she and the manufacturer are separate and apart from this contract. The customer acknowledges that by signing this agreement the dealer is not responsible for the manufacturer’s acts or omissions related in any way with the manufacture of the building or the delivery and/or installation of the building.
